BOISE, ID - As the court battle regarding the legalization of gay marriage in Idaho begins to heat up, a new lawsuit has been filed by a female navy veteran.

She hopes to one day be buried in a military cemetery alongside her late wife.

Veteran Madelynn Lee Taylor, 74, who served from 1958 to 1964, is now fighting again in a different type of battle. Taylor joined forces with The National Center for Lesbian Rights to file a suit against Idaho Division of Veterans Services Administrator David E. Brasuell Monday.

Taylor was married in 2008 to Jean Francis Mixner in California. In Idaho, their marriage remains unrecognized. Taylor is asking that the ashes of Mixner be buried with her at the Idaho State Veterans Cemetery, however according to Idaho statute, a valid marriage certificate is required to do so.
