In a hearing on the motion for retrial today, defense attorney Paul Clark and Prosecuting attorney Dan Spickler made their arguments for and against a retrial.
Thomas was convicted of 1st degree murder on December 16th for the strangling of his ex-wife, Beth Irby-Thomas. Although Thomas appeared to accept the court's decision, cries still came from the audience.
In a separate motion, Clark asked to withdraw as Thomas' attorney after he was not paid the more than $10,000 he's still owed from the first trial. He said he did not have the ability to make that kind of financial commitment. However, it was decided that since Clark is a close family friend and since he's so invested in the trial, he will remain on Thomas' case until a sentence is issued.
