Hodges attorney asks judge to reconsider motion to dismiss murder indictment
LEWISTON, ID - A motion to dismiss a first degree murder indictment is denied, and now the defense is hoping the judge will reconsider.

More than six months ago a grand jury in Nez Perce County decided there was enough evidence to charge Natasha Nichole Hodges with first degree murder for the death of two-year-old Rylee Mingo.

Since then Defense Attorney Rick Cuddihy filed a motion to dismiss that indictment, after claiming the prosecutor made errors that tainted the grand jury process. The judge has denied the motion, however the defense is not stopping as they're asking him to reconsider.

The judge is expected to issue a written opinion soon. If the judge decides not to dismiss the indictment a jury trial is set for March.
