ASOTIN, WA - Hoisington's attorney, Dale Slack, has filed a motion for a change of venue, citing reasons such as too much pre-trial publicity; claiming "an impartial trial cannot be held in Asotin County."

The 60-year-old defendant was convicted of three Valley rapes between 1977 and 1991, two in Lewiston and one in Clarkston, resulting in a life sentence.

Back in September, a Joint Forensic Unit with the Washington Attorney General's Office determined Hoisington no longer met the criteria of a sexually violent predator and it was recommended he be released.

Prosecuting Attorney Ben Nichols said he's currently working on his response to the latest motion. Judge William Acey will consider the motion in a hearing on January 30th. The trial is scheduled for February 14th.
