Bank robber appeals his sentence
LEWISTON, ID - A bank robber seeks an appeal of his sentence for eight years to life in prison.

On February 3rd of 2011, David Payton, 70, of Clarkston robbed the Lewiston Main Street US Bank.

On January 9th of this year, he appeared in 2nd District Court with six charges for robbery, aggravated assault and the use of a deadly weapon.

Payton pleaded guilty to robbery, as well as one of four counts for aggravated assault and the use of a deadly weapon.

He gave up his right to appeal certain aspects of his case as part of a sentencing agreement that allows him to argue for leniency.

The Idaho State Appellate Public Defenders office appealed the sentence.
