Prosecution rests in Grove murder trial

LEWISTON - The prosecution rested its case Thursday in the first-degree murder trial of a Lewiston man.

It was another short day at the trial of Stacy L. Grove, as it continued in Nez Perce County 2nd District Court.

Grove is accused of brutally beating 23-month-old Kyler Martin to death in July of 2006.

Nez Perce County Prosecutor Dan Spickler called his last witness to the stand Thursday morning. Debra Harper, a general pediatrician with Group Health in Spokane, described her experience with Kyler and his family. In her testimony, Harper said Kyler appeared brain-dead by the time she was called to examine him.

She corroborated earlier testimony, disputing Grove's claim that Kyler's injuries resulted from a fall off a counter. Harper cited torn intestinal tissue that she says is normally "strong as canvas." She said that kind of injury could only be sustained from something as severe as an "unbelted passenger in a car accident or being hit with a baseball bat," as a couple of examples.

Harper said Grove did not say anything about a fall off a counter when she met with the family after the boy's death. She called it unusual, but "within the realm of human nature."

After the morning session, Judge Carl Kerrick recessed the trial for the day and ordered court back in session for a full day Friday.

Grove is expected to take the stand in his own defense.
