ASOTIN - A man accused of second-degree murder and leaving the scene of an injury accident in Lewiston appeared in court Wednesday in Asotin County on separate charges.

In Nez Perce County, 45-year-old-James W Schuetze is charged in connection with the death of 8-year-old Sydney Byrd, who died after being struck by a vehicle near her apartment last Thursday.

In Asotin County Shuetze is facing criminal driving under the influence charges as well as driving with a suspended license. Wednesday morning he appeared via video before Judge Ray Lutes in District Court. Lutes decided to hold over the arraignment and hearing until Friday because Shuetze's attorney Jane Richards had been unable to meet with him.

Shuetze is facing extradition to Nez Perce County.

"When someone gets arrested in one state on charges out of another state, usually on a warrant issued by the other state, in order for them to be transferred back to the state where they have been charged they have to be extradited,” said Asotin County Prosecutor Ben Nichols. “They can either waive the formal process and agree to go back to the state where the charges are, or they can demand formal extradition proceedings."

Nichols says formal proceedings would include the governor of Idaho sending a letter to the governor of Washington, requesting the prisoner be transferred. This process can take several months. But before Shuetze can go through the extradition process, Nichols said he'll have to face the Asotin County charges.

"He has criminal charges here in Asotin County. So in order for him to go back to Nez Perce County, our charges would have to be dropped, or we would have to authorize his release from jail, or he would have to post bond on this side of the river. Then he could waive extradition. As long as there is a local hold on someone they can't be extradited because they have to take care of this matter before they get to go to the other state."

Shuetze is being held on a $100,000 bond out of Nez Perce County and a $50,000 bond in Asotin County.
