Kellis now faces child rape charge in Asotin County

ASOTIN - Timothy A. Kellis, 39, will not stay in the Latah County Jail much longer, unless he fights extradition to Asotin County.

Kellis faces a charge of rape of a child in the second degree in Asotin County. The Latah County trial and sentencing had to be completed before proceeding with the Asotin County case.

"The ways that he can come back to our jurisdiction can be one, he can waive extradition and he could be transported almost immediately within the next few days, or if he decides to fight jurisdiction, then Latah County will notify us that he's fighting jurisdiction and we'll notify the governor's office the Washington governor will talk to the Idaho governor," said Asotin County Deputy Prosecutor Joe Jackson. "Then there is a drawn-out process where eventually the extradition will be determined and he will be brought back to our jurisdiction."

Jackson said in most cases suspects waive extradition. If Kellis does, he could be in Asotin County within a few days. If he fights it, it could take several weeks.

Kellis is a former color guard instructor for the marching band at Clarkston High School. The alleged rape victim claims he met Kellis at band camp at Camp Wooten, near Pomeroy. The boy told police he was a student at Lincoln Middle School when, under Kellis' mentoring, he joined the Clarkston High marching band.

The report contains emails exchanged between Kellis, then-band director Fred Dole and former CHS principal Van Cummings concerning middle school students participating on the color guard and winter guard.

The emails were dated early 2004. In them, there's a discussion of whether or not it was appropriate to have middle school students participating in color guard.

Also in the report are allegations that the boy would often spend the night at Kellis' Clarkston home and wake up to "improper touching."
