No charges in connection with Moscow bar parking lot death

The Latah County Prosecutor's Office announced Wednesday that the Moscow Police Department has completed its investigation regarding the July, 9 2008 death of 50-year-old Kristian Lee Nelson. Prosecuting Attorney Bill Thompson said his office and the Moscow City Attorney's Office have concluded that there was no crime committed.
Thompson said 36-year-old Shelby C. Shoemaker of Moscow ran over Nelson with her 1998 Dodge Durango while he was lying in the parking lot of the Corner Club. Nelson had been drinking heavily, according to a toxicology report, and was apparently passed out at the time of the accident. Shoemaker did not stop after running over Nelson.
Moscow Police Officers and Idaho State Police collision reconstruction experts re-enacted the accident, and determined Shoemaker could not have seen Nelson. They also took into account that Shoemaker was going downhill while turning right and transitioning from pavement to gravel.
Based on the evidence, it was determined that there are no grounds for criminal charges.
(CORRECTION: An earlier version of this web story incorrectly indicated that Shoemaker had been drinking the day of the accident. This was an editor's error. The victim, Nelson, is in fact the person who police say had been drinking.)
