Another judge requested in fatal boat crash case

ASOTIN - Wednesday, the defense requested a new judge for a second time in the case against Gordon Higheagle Jr.

The 34-year-old from Lapwai is charged with 1 count of homicide with a watercraft and 4 counts of reckless endangerment, stemming from a boat crash on the Snake River in August which killed 15-year-old Jonas Yochum of Lewiston.

According to the police report, the arresting deputy could smell liquor on Higheagle's breath and a warrant was issued for a blood test.

Also in the report, Higheagle said he did not see Yochum's boat until he hit it.

Last month defense attorney Jane Richards filed a motion of prejudice against Asotin County Superior Court Judge William Acey. Judge John Henry was appointed to the case and Tuesday a hearing was scheduled for September 8th.

Wednesday Richards filed a second motion for another change of judge. No decision on that has been made yet.
